Overview

Welcome to Krutiv! Throughout this website, the terms “we,” “us,” and “our” refer to Krutiv, the official brand storefront owned and legally operated by Vision Sales & Services. Vision Sales & Services operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a curated shopping experience (the “Services”). Krutiv is powered by Shopify, which enables us to provide the Services to you. These Terms of Service, together with our Return, Replacement and Refund Policy, Shipping Policy, and Privacy Policy (collectively, the “Policies”), describe your rights and responsibilities when you use the Services. By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Policies. If you do not agree, you should not use or access our Services.

Section 1 — Access and Account

By agreeing to these Terms of Service, you represent that you are at least 18 years of age, the age of majority in India under the Indian Majority Act, 1875, or that you are using the Services under the supervision of a parent or legal guardian who consents to your use. To use the Services, including browsing our store or purchasing products, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it. You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.

Section 2 — Our Products

We make every effort to accurately represent our products in our online store. Because each item is custom-printed on demand, please note that colours or print appearance may differ slightly from how they appear on your screen due to your device’s display settings. We do not warrant that the appearance of any product will be identical to its on-screen depiction; this is a manufacturing tolerance, not a defect (see our Return, Replacement and Refund Policy for what is and isn’t covered under this tolerance). All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product or limit quantities offered, at our discretion.

Section 3 — Orders

When you place an order, you are making an offer to purchase, which Krutiv may accept or decline at its discretion. Your order is not accepted until Krutiv confirms acceptance, and we must receive and process your payment before your order is accepted. Because every item is custom-printed to order, cancellations are only possible within 1 hour of placing your order, before production begins; please refer to our Return, Replacement and Refund Policy for the exact cancellation process. Once production has started, the order cannot be cancelled, modified, or refunded for change of mind. If we are unable to accept, must change, or must cancel an order after acceptance, we will notify you using the email, billing address, or phone number provided at checkout. Returns, replacements, and refunds are handled solely in accordance with our Return, Replacement and Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

Section 4 — Prices and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation email. All prices listed on our website are inclusive of applicable Goods and Services Tax (GST), unless otherwise stated. As we currently ship only within India, no customs or import charges apply. Shipping charges, if applicable, are calculated and displayed separately at checkout. Prices in our online store may differ from prices in any other store or sales channel. Promotional offers are governed by their own terms, which will prevail over these Terms in case of conflict. You agree to provide current, complete, and accurate payment and account information, and you represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are duly authorized to use the payment method provided, (iii) charges incurred will be honoured by your bank or payment provider, and (iv) you will pay all charges incurred at the posted prices, including shipping and applicable taxes.

Section 5 — Shipping and Delivery

All delivery timelines stated on our website or in our Shipping Policy are estimates only and are not guaranteed delivery dates. We are not liable for delays caused by courier networks, weather, regional restrictions, or other circumstances outside our reasonable control. However, we remain responsible for resolving claims relating to transit damage, misprints, or fulfillment errors strictly in accordance with our Return, Replacement and Refund Policy, regardless of whether the product has already been handed over to our courier partner. Please refer to our Shipping Policy for full details on processing times, delivery estimates, and address-related delivery failures.

Section 6 — Intellectual Property

Our Services, including all trademarks, brand names, text, designs, images, graphics, and the selection and arrangement thereof, are owned by Vision Sales & Services (operating as Krutiv), its affiliates, or licensors, and are protected under applicable Indian copyright, trademark, and other intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999. These Terms permit you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from the Services without our prior written consent. Nothing in these Terms grants you any license or right under any patent, trademark, copyright, or other intellectual property of Krutiv, Vision Sales & Services, Shopify, or any third party, except as expressly stated. Unauthorised use may violate applicable intellectual property laws, and all rights not expressly granted are reserved by Vision Sales & Services. Krutiv’s name, logo, product names, designs, and slogans are trademarks of Vision Sales & Services or its licensors and must not be used without prior written permission. Shopify’s name, logo, and related marks are trademarks of Shopify. All other names, logos, and marks on the Services belong to their respective owners.

Section 7 — Optional Tools

You may be given access to third-party tools as part of the Services, which we do not monitor or control. Such tools are provided “as is” and “as available,” without any warranty or endorsement, and we have no liability arising from your use of them. Use of optional third-party tools is entirely at your own risk, and you should review the relevant third party’s own terms before use. Any new features or tools we introduce in the future will also be considered part of the Services and subject to these Terms.

Section 8 — Third-Party Links

The Services may contain links to third-party websites or content that we do not control or endorse. We are not responsible for examining or evaluating the accuracy or content of any third-party site, and you access such sites entirely at your own risk. We are not liable for any harm arising from your use of third-party websites, products, or services. Please review the relevant third party’s own policies before engaging in any transaction with them, and direct any complaints about third-party products or services to that third party directly.

Section 9 — Relationship with Shopify

Krutiv is powered by Shopify, which enables us to provide the Services to you. Any sales or purchases made through our store are made directly with Vision Sales & Services (operating as Krutiv). Shopify is not responsible for any aspect of sales between you and us, including any injury, damage, or loss arising from purchased products. You release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with us.

Section 10 — Third-Party Fulfillment

Krutiv works with third-party print-on-demand manufacturing and logistics partners to fulfill your order. Regardless of which manufacturing or logistics partner is used, your purchase contract is solely with Vision Sales & Services, who remains fully responsible for resolving any order issues, including those relating to production, quality, or delivery, in accordance with our Return, Replacement and Refund Policy and Shipping Policy.

Section 11 — Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify’s Privacy Policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify and other service providers, including those located outside India, solely to provide the Services to you. Review our Privacy Policy for full details on how we, Shopify, and our partners use your personal information.

Section 12 — Feedback

If you submit any ideas, suggestions, reviews, or other feedback (“Feedback”), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and display such Feedback for any purpose, including commercial use. We are under no obligation to keep your Feedback confidential, compensate you for it, or respond to it. We may, but are not obligated to, monitor, edit, or remove Feedback that we determine to be unlawful, offensive, or in violation of these Terms or any third party’s rights. You represent and warrant that you own or have the necessary rights to your Feedback, that it does not violate any third party’s rights, and that it does not contain unlawful, abusive, or malicious content. You are solely responsible for your Feedback and its accuracy.

Section 13 — Errors, Inaccuracies, and Omissions

Our Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to correct such errors and to change, update, or cancel orders affected by inaccurate information at any time, including after an order has been submitted, and will notify you if your order is affected.

Section 14 — Prohibited Uses

You may access and use the Services for lawful purposes only. You agree not to: use the Services for any unlawful or malicious purpose; violate any applicable law or regulation; infringe our intellectual property or that of others; harass, abuse, or harm any person; transmit false or misleading information; send spam or unauthorised promotional material; impersonate any person or entity; upload viruses or malicious code; scrape, extract, or harvest data from the Services using automated tools, bots, or AI agents without our consent; collect personal information about other users; or bypass or interfere with any security or access-control measure on the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine you have violated these Terms.

Section 15 — Agents

This section applies if you use, enable, or deploy any software or service that takes autonomous or semi-autonomous action on your behalf to access or interact with the Services (“Agent”). Any Agent must identify itself as such in all requests (for example, by including “Agent/[agent name]” in the request’s user agent string), must not conceal that it is an Agent or attempt to mimic human behaviour, must respond truthfully if asked whether it is a human or a computer, and must not bypass any access controls we have put in place. We may limit or block Agent access to the Services at our discretion, and no Agent may access the Services if we have specifically requested that it not do so.

Section 16 — Termination

We may terminate this agreement or your access to the Services at our discretion, at any time, without notice, and you will remain liable for all amounts due up to the date of termination. Sections relating to Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, and Privacy will survive termination.

Section 17 — Disclaimer of Warranties

Information presented on the Services is provided for general informational purposes only, and we do not warrant its accuracy, completeness, or usefulness. Except as expressly set out in our Return, Replacement and Refund Policy, the Services and all products offered through them are provided “as is” and “as available,” without warranties or conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free. Nothing in this section limits or excludes any right or remedy you are entitled to under the Consumer Protection Act, 2019, or any other applicable Indian law that cannot be lawfully excluded.

Section 18 — Limitation of Liability

To the fullest extent permitted under Indian law, Vision Sales & Services, its partners, directors, officers, employees, affiliates, agents, contractors, service providers, or licensors, or those of Shopify and its affiliates, shall not be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, including lost profits, lost revenue, or loss of data, arising from your use of the Services or any product procured through them, whether based in contract, tort, strict liability, or otherwise, even if advised of the possibility of such damages. Nothing in this section excludes or limits liability for death, personal injury, or fraud, where such exclusion is not permitted under applicable Indian law.

Section 19 — Indemnification

You agree to indemnify, defend, and hold harmless Vision Sales & Services, Krutiv, Shopify, and their respective affiliates, partners, officers, directors, employees, agents, contractors, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, arising out of (1) your breach of these Terms or any Policy referenced herein, (2) your violation of any law or third party’s rights, or (3) your access to or use of the Services. We will notify you of any indemnifiable claim, and may control its defense and settlement at your expense, but will not settle any claim requiring a non-monetary obligation from you without your consent.

Section 20 — Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remainder of these Terms will remain in full force and effect.

Section 21 — Waiver; Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with our Return, Replacement and Refund Policy, Shipping Policy, and Privacy Policy, constitute the entire agreement between you and us regarding your use of the Services, superseding any prior agreements or communications, whether oral or written.

Section 22 — Assignment

You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent. We may transfer, assign, or delegate these Terms and our rights and obligations without notice to you.

Section 23 — Governing Law

These Terms of Service, and any disputes arising from your use of the Services, shall be governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra. You may also approach the National Consumer Helpline (1915) or file a complaint via the e-daakhil portal under the Consumer Protection Act, 2019.

Section 24 — Grievance Redressal

If you have any grievance regarding these Terms or your use of the Services, you may contact our Grievance Officer at krutiv@zohomail.in, marking the subject line “Grievance — [brief description].” We will acknowledge your grievance within 48 hours and aim to resolve it within 30 days, in accordance with the Consumer Protection (E-Commerce) Rules, 2020.

The headings used in these Terms are included for convenience only and do not limit or affect their interpretation.

Section 26 — Changes to Terms of Service

We may update, change, or replace any part of these Terms at our discretion by posting the revised version on our website. It is your responsibility to check this page periodically. We will notify you of any material changes where required under applicable law. Your continued use of the Services after such changes are posted constitutes your acceptance of the revised Terms.
